Attorney Fees

Pursuant to Family Code Section 2030, the Court may make an order for the party earning a higher income to pay a portion of the other party’s attorney fees and/or costs. Additionally, the Court may order that either or both parties access a community account to assist in their payment of attorney fees and costs.

Many times, attorney fees are ordered to be paid on a monthly basis until paid in full, unless there are assets available, or a party has sufficient income to pay the amount ordered at one time.

The Court may consider the separate property of either spouse, and any support orders when making an order for attorney fees as well.
